New Building Act from April 1, 2025

The new Building Act will come into force on 1 April 2025, with the necessary modifications, which were adopted by the Parliament on 5.2.2025. 

The legislator finally decided to amend the original Act No. 50/1976 Coll. on Spatial Planning and Building Regulations (Building Act) and at the same time to repeal the Building Act drafted by the previous government. 

The amended law introduces new institutes to make the construction procedure as a whole clearer and simpler; among the most significant changes are the following: 

Integration of permits 

Several decisions or consents will be merged into one construction procedure for a main building that consists of several buildings or a set of buildings forming a functional unit. 

Integration of planning and building procedures 

The procedures will not be split into planning and building procedures but will be merged into one integrated procedure, provided that the location of the buildings is determined by the zoning plan or the binding opinion of the planning authority. 

Clear deadline for the issue of the permit 

The municipality, as the building authority, will have a time limit of 60 days or 90 days to issue an opinion, depending on the nature of the construction. 

If the municipality does not give its opinion within this period, the fiction of consent will be triggered - the proposed construction will be deemed to be in accordance with the binding part of the planning documentation. 

Discussion of the project in the preparatory phase 

The obligation for the developer to discuss the construction plan with the municipality, the authorities concerned, and the parties to the proceedings are introduced in the preparatory phase before the commencement of the proceedings at the building office. 

Despite the original intention to remove the competence of municipalities in the field of building permits, the adopted amendment maintains municipalities as the competent authorities for issuing permits. 

Simple and minor constructions 

As a benefit for small builders, we see an extension and clearer definition of simple constructions, minor constructions and constructions where no building permit is required.
